ARTICLE I. INCORPORATION, POWERS AND TERRITORY Sec. 1. Corporate name and status. The inhabitants of the City of Texas City, in Galveston County, Texas, residing within its territorial limits, as these limits are now established or are hereafter established in the manner provided by law, shall continue to be and are hereby constituted a body-politic and corporate by the name of the City of Texas City, and under that name shall have perpetual succession; may use a corporate seal; may sue and be sued; may acquire property within or without its boundaries for any municipal purpose, in fee simple or lesser interest or estate, by purchase, gift, devise, lease, or condemnation and may sell, lease, hold, manage, and control such property as its interest may require; may cooperate with the government of the United States or any agency of the government of the United States or the government of the State of Texas, or any political subdivision or agency of the State of Texas, to accomplish any lawful purpose for the advancement of the interest, welfare, health, morals, comfort, safety, and convenience of the city and its inhabitants; and may pass such ordinances as may be expedient for maintaining and promoting the peace and government and welfare of the city and for the performance of the functions thereof; and, except as prohibited by the Constitution and laws of the State of Texas or restricted by the Charter, the city shall have and may exercise all municipal powers, functions, rights, privileges, and immunities of every nature whatsoever. Sec. 2. Enumerated powers not exclusive. The enumeration of particular powers by this Charter shall not be held or deemed to be exclusive, but, in addition to the powers enumerated herein or implied hereby, or appropriate to the exercise of such powers, it is intended that the City of Texas City shall have, and may exercise, all powers of local self-government, and all powers under the Constitution and laws of the State of Texas which would be competent for this Charter specifically to enumerate. All powers of the city, whether expressed or implied, shall be exercised in the manner prescribed by this Charter, or if not prescribed therein, then in the manner provided by ordinance or resolution of the commission. Sec. 3. Boundaries of city. The boundaries of the city shall be the same as have been heretofore established and now exist and those boundaries established and changed hereafter in all annexation and disannexation proceedings of the city, filed in the office of the city secretary. The city commission may by ordinance annex territory adjacent to the city, with or without the consent of the owners or inhabitants of the annexed territory, and subject to the procedural rules prescribed by the laws of the State of Texas. The city commission, after a public hearing and a majority vote of the commission, may by ordinance pursuant to state law and this Charter disannex any property lying within and adjacent to the boundary limits of the city, and lying adjacent to the city limits. |
